Agreement to Terms
These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("Client", "you", "your") and Lifted Spirits, LLC, a California limited liability company ("Lifted Spirits", "we", "us", "our").
By booking, accessing, or using any services provided by Lifted Spirits, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms in their entirety, you must not use our services.
These Terms apply to all clients, event hosts, guests, and any individuals who engage with our services in any capacity.
Services Description
Lifted Spirits provides premium mobile bartending and mixology services for private events, including but not limited to:
- Weddings, receptions, and engagement parties
- Corporate events, conferences, and networking functions
- Private celebrations, birthdays, and anniversaries
- Holiday parties and seasonal gatherings
- Fundraisers and charity events
Our services include professional bartenders, craft cocktail preparation, beverage service, bar setup and breakdown, and optional premium add-ons as specified in your service agreement.
All services are subject to availability, booking confirmation, and execution of a signed service agreement. We reserve the right to refuse service to any individual or event for any lawful reason at our sole discretion.
Eligibility and Age Requirements
Age Restriction - 21+ Only
All services provided by Lifted Spirits involve the preparation, handling, and service of alcoholic beverages. Our services are exclusively intended for individuals who are 21 years of age or older.
As the Client and event host, you represent and warrant that you are at least 21 years of age. You further agree to ensure that all guests consuming alcoholic beverages at your event are 21 years of age or older and possess valid government-issued identification.
Our staff reserves the right to request identification from any individual at any time and to refuse service to any person who:
- Cannot provide valid proof of being 21 years of age or older
- Appears to be intoxicated or impaired
- Exhibits disruptive, aggressive, or inappropriate behavior
- Violates any applicable laws or regulations
Lifted Spirits maintains a zero-tolerance policy for serving minors. Any attempt to provide alcohol to individuals under 21 will result in immediate termination of services without refund.
Booking Process and Confirmation
Bookings are initiated through our inquiry form, phone consultation, or email correspondence. A booking becomes confirmed only upon:
- Receipt and acceptance of your completed inquiry with event details
- Our written confirmation of availability for your requested date and time
- Execution of a signed service agreement by both parties
- Receipt of any required deposit or advance payment as specified
No booking is considered confirmed until all four conditions above are satisfied. We recommend booking at least 4-6 weeks in advance for optimal availability, particularly during peak seasons (May-October, November-December).
Once confirmed, you will receive a detailed service agreement outlining the scope of services, pricing, payment schedule, and event-specific terms.
Pricing and Payment Terms
All pricing is provided via custom quotation based on your specific event requirements, including but not limited to guest count, service duration, package selection, and add-on services.
Payment Structure:
- Deposit: A non-refundable deposit may be required to secure your booking date. Deposit amounts vary based on event size and are specified in your service agreement.
- Balance Payment: Final balance is due according to the timeline specified in your service agreement, typically 7-14 days prior to the event date.
- Payment Methods: We accept major credit cards, debit cards, bank transfers, and other methods as specified in your service agreement.
Additional Charges:
Additional charges may apply for services beyond the scope of your original agreement, including but not limited to:
- Event time extensions beyond the agreed service hours
- Additional guest count exceeding the agreed number
- Last-minute service additions or upgrades
- Travel fees for locations outside our standard service area
- Special equipment rentals or premium ingredient costs
All pricing is subject to change without notice prior to booking confirmation. Prices are locked in once your service agreement is signed by both parties.
Cancellation, Postponement, and Refund Policy
Client-Initiated Cancellation:
- More than 60 days before event: Full refund of payments made, minus any non-refundable deposit (if applicable)
- 30-60 days before event: 50% refund of payments made
- Less than 30 days before event: No refund
Event Postponement:
If you need to postpone your event, we will make every reasonable effort to accommodate a new date based on our availability. One postponement is typically allowed without penalty if requested more than 60 days in advance. Subsequent postponements may incur administrative fees.
Lifted Spirits-Initiated Cancellation:
In the unlikely event that we must cancel your booking (due to unforeseen circumstances, illness, or force majeure events), we will provide a full refund of all payments made and make reasonable efforts to refer you to alternative service providers.
Insurance and Liability Coverage
Fully Insured and Certified
Lifted Spirits maintains comprehensive general liability insurance with coverage up to $2,000,000 per occurrence. All bartenders are ABC-certified and undergo regular training.
Our insurance coverage includes protection for property damage, bodily injury, and liquor liability arising from our operations. Certificate of Insurance can be provided to venues upon request.
Limitation of Liability
IMPORTANT - PLEASE READ CAREFULLY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LIFTED SPIRITS, LLC, ITS OWNERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Loss of data, goodwill, or reputation
- Emotional distress or personal injury (except as covered by our insurance)
- Property damage (except as covered by our insurance)
- Third-party claims arising from guest conduct or alcohol consumption
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO LIFTED SPIRITS FOR THE SPECIFIC EVENT GIVING RISE TO THE CLAIM.
We are not liable for any accidents, injuries, damages, or losses arising from:
- Guest behavior, conduct, or alcohol consumption
- Venue conditions, safety hazards, or third-party negligence
- Acts of God, force majeure events, or circumstances beyond our reasonable control
- Client's failure to comply with their obligations under this Agreement
